The purpose of this
study was to identify the problem of no
grace period in giving birth certificate
and the use of birth certificates. The study was conducted from July to
September 2015 at the Civil Registry Office of Samarinda. The methods and
techniques used in this research were the method of inductive and deductive
methods. The study used formal juridical and sociological juridical approach.
The data collection was conducted through
field studies using observation sheet and interview guide. The
respondents of the study were staffs of the Registry and some societies in
Samarinda. After collecting the data, further they were selected and analyzed . The results analysis showed
that: (1) to obtain birth certificates for the indigenous groups and to obtain
birth certificates for common groups,
the reporting period was 60 days or 2 months. It must be submitted to the Civil
Registry Office. The late report was carried out through the trial
Court. Beside the Decree of the Minister of Home Affairs on October 14, 2012
Number. 474-785, there was again the way to get a birth certificate with the
term of privileged birth certificate. The birth certificate obtained after
passing the limit of the report period.
On the present time, there was no grace
period for reporting the birth, with consideration
of the government, the society of
Indonesia paid closed attention the important events of birth, and (2) The
birth certificate was useful for the society because it will be easier to solve
the problem that related to the birth
certificate and those who have the birth certificate implemented some of the
existing laws in our country.
