The purpose of this research is: (1) in order to figure out the existence of
land provisioning arrangement in the edge of DAS Mahakam to build places for
business purposes, and (2) in order to understand the process of DAS Mahakam
fulfillment in many land affairs regulations and also the other regulations that is
related to entrepreneurship.The research is held in DAS area, Anggana, Kutai
Kartanegara Residence, East Kalimantan in 4 months. This research uses a
normative juridical method (library research) and empirical juridical method (field
research), based on interview result and direct interview with the owner of gas
supplier in DAS Mahakam. Research data are qualitative descriptively analyzed.
The result of a research shows that: (1) empirically, development that is based on
economy growth in using the right of usage that is mostly supported by natural
resources exploitation is provided by a very responsive and accommodative policy
toward that activity, the decline of quality and quantity of natural resources and
many other social impact is still happening and even increasing not only the
quantity but also the complexity; and (2) in normative level of orientation
philosophy and UUPA principles, because it is based on a pragmatic and sectoral
consideration, as the consequence is beside that the position of UUPA is degradated
become a sectoral regulation, it is not consistent and even overlapping with another
impact toward the implemented level.
